CrazyGoldFish Terms of Service

These Terms of Service ("Terms") govern your access to and use of the CrazyGoldFish website and any CrazyGoldFish products, APIs, dashboards, sandbox environments, documentation, and related services (collectively, the "Services") provided by CrazyGoldFish Technologies Private Limited ("CrazyGoldFish", "we", "our", "us").
By accessing or using the Services, you agree to these Terms.
1) Who We Are

2) These Terms vs. Your SaaS Agreement
If you are using the Services on behalf of an institution, platform, school network, NGO, or company, your use may also be governed by a separate written agreement (e.g., a Software as a Service Agreement / Order Form / Statement of Work) ("Customer Agreement").
- If a Customer Agreement exists, it governs your use of the Services to the extent it conflicts with these Terms.
- These Terms primarily govern website use, evaluation/sandbox access, and non-contracted usage.
3) Eligibility and Authority
You must be able to form a binding contract to use the Services. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms (and any Customer Agreement).
4) Accounts, Access, and Authorized Users
You may need an account (or API credentials) to access the Services.
You agree to:
- Provide accurate information;
- Keep credentials secure and confidential;
- Ensure only authorized personnel access the Services;
- Promptly notify us of any unauthorized access or security incident.
We may suspend or disable accounts if we reasonably believe credentials are compromised or these Terms are violated.
5) Services Overview
CrazyGoldFish provides API-based services and workflows that may include assessment/evaluation, feedback generation, personalization workflows, content generation, and related dashboards or embeddable interfaces.
Service availability, support scope, rate limits, and service levels (if any) may vary by environment (sandbox vs production) and may be described in the applicable Customer Agreement or product documentation.
6) Sandbox / Evaluation Environment
If you are using a sandbox or evaluation environment:
- Outputs are provided for testing and evaluation purposes only.
- Outputs may be incomplete, inaccurate, or non-final.
- You are responsible for validating outputs before any operational use.
We may apply usage limits or modify sandbox access to ensure system stability and fair use.
7) Acceptable Use
You agree not to (and not to allow others to):
- Use the Services unlawfully, or in a way that harms, disables, overloads, or impairs the Services.
- Attempt unauthorized access to the Services, accounts, systems, or networks.
- Use automated means not provided by CrazyGoldFish to access, scrape, or extract data.
- Reverse engineer, decompile, disassemble, or attempt to derive source code, models, or system prompts from the Services.
- Modify, copy, distribute, sell, resell, lease, sublicense, or create derivative works of the Services except as expressly permitted.
- Use the Services in any manner that compromises exam integrity, evaluation fairness, or institutional policies.
- Upload or transmit malicious code, or unlawful, infringing, defamatory, or privacy-violating material.
- Interfere with or disrupt the integrity, security, or performance of the Services.
We may investigate violations and suspend or terminate access.
8) Client Data and Responsibility for Inputs
"Client Data" means all data, content, materials, or information uploaded, submitted, transmitted, or processed through the Services by you or on your behalf.
You are solely responsible for:
- The accuracy, quality, legality, reliability, and appropriateness of Client Data;
- Having all necessary rights, permissions, and consents to provide Client Data (including student data where applicable);
- Ensuring compliance with applicable laws, institutional policies, and consent requirements.
9) Privacy and Data Protection

If you are an institutional customer, the Customer Agreement may include additional data processing terms (controller/processor roles, security measures, breach notification, deletion/return, audit rights, etc.).
10) AI Outputs, Human Review, and No Guarantee
The Services may generate outputs such as scores, feedback, mappings, recommendations, or content using automated methods.
You acknowledge:
- Outputs may contain errors, inaccuracies, or inconsistencies;
- You are responsible for reviewing and validating outputs before use;
- In high-stakes contexts, outputs should be used in a governed workflow where authorized educators or institutional reviewers remain the final authority.
No guarantee: We do not guarantee outputs will be accurate, complete, or suitable for any particular purpose unless expressly stated in a Customer Agreement.
11) Intellectual Property
11.1 Our IP
CrazyGoldFish retains all rights, title, and interest in and to:
- The Services, APIs, documentation, software, algorithms, workflows, interfaces, and related technology;
- All improvements, updates, and modifications.
No rights are granted except as expressly stated in these Terms or a Customer Agreement.
11.2 Your IP
You retain rights in your Client Data. You grant CrazyGoldFish a limited license to host, process, and use Client Data only as necessary to provide and maintain the Services, and as permitted by the Customer Agreement (if applicable).
11.3 Feedback
If you provide feedback, suggestions, or recommendations, you grant CrazyGoldFish a worldwide, royalty-free license to use it to improve the Services, without obligation to you.
12) Third-Party Services
Certain parts of the Services may rely on third-party infrastructure or models. We are not responsible for outages or failures caused by third-party systems beyond our control, though we will use commercially reasonable efforts to restore service and provide updates as appropriate.
13) Fees and Payment (If Applicable)
Some Services may be paid. Fees, invoicing, usage-based billing, taxes, and payment terms (if applicable) are specified in the relevant Customer Agreement or Order Form.
If you are using a sandbox provided free for evaluation, fees may not apply.
14) Suspension and Termination
We may suspend or terminate access to the Services:
- If you violate these Terms;
- If your use poses a security, compliance, or operational risk;
- If required by law.
You may stop using the Services at any time. Termination provisions for production use are governed by the Customer Agreement.
Upon termination, you must stop using the Services and delete any access credentials. Data deletion/return is handled per the Privacy Policy and/or Customer Agreement.
15) Disclaimers
EXCEPT AS EXPRESSLY STATED IN A CUSTOMER AGREEMENT, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRAZYGOLDFISH DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
16) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- CRAZYGOLDFISH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL).
- OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SERVICES SHALL BE LIMITED AS SET OUT IN THE CUSTOMER AGREEMENT, OR IF NO CUSTOMER AGREEMENT EXISTS, LIMITED TO THE AMOUNT (IF ANY) PAID BY YOU TO CRAZYGOLDFISH FOR THE SERVICES IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY.
Some jurisdictions do not allow certain limitations; in that case, limitations apply to the greatest extent permitted.
17) Indemnity
If you are using the Services on behalf of an organization, you agree to indemnify and hold harmless CrazyGoldFish from claims arising out of:
- Your Client Data;
- Your unlawful or prohibited use of the Services;
- Your violation of rights of any third party.
Indemnity terms for production deployments may be further defined in the Customer Agreement.
18) Changes to These Terms
We may update these Terms from time to time. If changes are material, we will post an updated version on our website. Continued use of the Services after changes become effective constitutes acceptance.
19) Governing Law and Jurisdiction
These Terms are governed by the laws of India. Courts in New Delhi, India shall have exclusive jurisdiction over disputes arising out of or related to these Terms, unless a Customer Agreement states otherwise.
